Welcome to SpoonScan. These Terms of Service ("Terms") govern your access to and use of the SpoonScan mobile application and services (collectively, the "Service"). By downloading, installing, or using SpoonScan, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and SpoonScan LLC. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
SpoonScan is a subscription-based AI-powered recipe generation application that:
SpoonScan offers the following subscription options:
Prices are in US dollars and may vary by region. Subscription fees are charged by the Apple App Store, not by SpoonScan.
New subscribers may be eligible for a 5-day free trial. During the free trial period, you will have access to up to 3 recipe searches per day. The free trial will automatically convert to a paid subscription at the end of the 5-day period unless you cancel at least 24 hours before the trial ends.
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew at the same price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation will take effect at the end of your current billing period, and you will retain access until then. Refund requests are handled by Apple according to their refund policies.
We reserve the right to change subscription prices at any time. Price changes will be communicated in advance and will apply to subsequent billing periods after your current subscription expires.
You may use SpoonScan for personal, non-commercial purposes to generate recipes and manage your cooking needs.

SpoonScan provides optional wine, beer, and cocktail pairing suggestions as part of its recipe features. By accessing alcohol pairing content, you confirm that you are of legal drinking age in your jurisdiction (21 years or older in the United States). SpoonScan does not promote underage drinking and encourages responsible alcohol consumption. You agree not to access alcohol-related content if you are under the legal drinking age.
You retain all rights to content you provide to SpoonScan (photos, voice recordings, ingredient lists). As described in our Privacy Policy, this content is stored locally on your device and processed by third-party AI services to generate recipes.
Recipes generated by SpoonScan's AI are created specifically for you. While you may use these recipes for personal purposes, you acknowledge that similar recipes may be generated for other users with similar ingredients.

SpoonScan™ and all associated trademarks, logos, designs, and content are owned by SpoonScan LLC and protected by intellectual property laws. You may not use our intellectual property without prior written permission.
"SpoonScan" is a trademark of SpoonScan LLC, pending registration with the United States Patent and Trademark Office. The SpoonScan name, logo, and associated branding are protected intellectual property. You may not use the SpoonScan name or logo in any way that suggests endorsement, affiliation, or sponsorship without our prior written consent.
We grant you a limited, non-exclusive, non-transferable, revocable license to use SpoonScan for personal purposes in accordance with these Terms. This license does not include any right to:

You agree to indemnify and hold harmless SpoonScan, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
You may cancel your subscription at any time through the Platform. Your access will continue until the end of your billing period.
We may terminate or suspend your access immediately, without notice, if you:
Upon termination, your right to use the Service immediately ceases. Data stored locally on your device will remain, but you will no longer be able to generate new recipes.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes.
We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use after changes constitutes acceptance. Material changes will be communicated via the app or email.
SpoonScan is intended for users 13 years of age or older (or the minimum digital age of consent in your country, if higher).
The "Kids Mode" feature is designed for parents and caregivers to create recipes FOR children—not for children to operate the app directly.
SpoonScan employs automated content moderation to help ensure safe recipe generation:

These Terms are governed by the laws of the United States and the state in which we are incorporated, without regard to conflict of law principles.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association ("AAA"), except where prohibited by law.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
YOU AND SPOONSCAN LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and SpoonScan LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
You may opt out of this arbitration agreement by sending written notice to support@spoonscan.com within 30 days of first using the Service. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SpoonScan LLC.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not transfer or assign your rights under these Terms. We may assign our rights to any affiliate or successor.
